In an eye-opening explanation that’s been making waves online, a criminal defense lawyer has warned everyday shoppers about the risks of using self-checkout machines — and it’s not for the reasons you might think.

According to the attorney, who has worked on multiple retail theft cases, self-checkout systems are creating a legal minefield for ordinary people. Here’s why:

1. Honest Mistakes Can Look Like Theft

Imagine scanning your items and accidentally missing one — a small bag of candy or a bottle of shampoo. It’s an easy mistake. But security footage won’t always show intent. And in many states, stores have been increasingly aggressive in prosecuting even low-dollar thefts.

“Even if it was an honest mistake, once it’s flagged, it becomes a question of intent — and that’s where it can get dangerous,” the lawyer explains. “You could find yourself facing charges and needing legal representation over a $5 item.”

2. Loss Prevention Teams Are Watching

Retailers have invested heavily in AI-powered surveillance and store detectives. Some even review footage days or weeks later and then issue warrants or call police based on what they believe was theft. You may not even know you’re under investigation until it’s too late.

“There’s a presumption that the machine is always right — and that the customer isn’t,” the lawyer warns.

3. Prosecutors May Press Charges Even When Stores Don’t Want To

Even if the store eventually realizes it was a mistake or decides not to pursue the matter, local prosecutors can still move forward with charges. Once it’s in the system, it’s not always easy to stop.
